Henry, thanks for three part question.
First, I only ask candidates for non-competes, if they are currently em
ployed by a direct competitor. If they work at a competitor and have a non-compete, I will send to our attorney to review. Then I will have a call with our attorney to evaluate our risk of the candidate joining our company in a specific role. In most cases, even with director competitors, we will offer the position and the person may not be able to call on certain accounts for a set period of time or in extreme cases not be able to sell products, also for a specific period of time.
Second, if you are interviewing with a competitor, I would bring up the non-compete early in the interview process. You don’t want to be seen as hiding the non-compete or springing on the hiring manager after they have made you a job offer.
